CIPA Clarifies Public Access to Company Information in Botswana. The Companies and Intellectual Property Authority (CIPA) has issued a public notice clarifying how and why certain company information is accessible through its Online Business Registration System (OBRS).

According to the Authority, CIPA is legally mandated under the Companies Act and the Registration of Business Names Act to maintain an open and transparent register. As part of this responsibility, specific company details are made available for public inspection through the OBRS, while still observing applicable data protection requirements.

CIPA explained that the information accessible to the public is limited to what is required by law. This includes details considered necessary for regulators, financial institutions, law enforcement agencies, procurement and tender bodies, tax authorities, licensing authorities and other entities that rely on official records to carry out their statutory duties.

The Authority noted that public access to certain company information also plays an important role in supporting the wider business community. By making legally required details available, stakeholders are better equipped to make informed decisions, which contributes to transparency, accountability and trust in Botswana’s business environment.

In addition to domestic legislation, CIPA said it is guided by Botswana’s international commitments. These include compliance with standards set by the Financial Action Task Force (FATF), an intergovernmental body that focuses on combating money laundering, terrorist financing and other financial crimes.

Maintaining a transparent company register, the Authority stated, is part of the country’s efforts to meet these global standards. CIPA emphasised that the system is designed to balance data protection considerations with the need to provide relevant information that supports regulatory oversight and international compliance.

Through this clarification, CIPA aims to reassure the public and its clients that the visibility of company information is both legally grounded and aligned with national and international obligations.
