Botswana Moves to Level the Playing Field with New Employment Laws. Botswana is entering a period of transition in labour regulations as the Employment and Labour Relations Bill is set to redefine employment practices, particularly around fixed-term and permanent contracts. The new framework aims to ensure fairness and equality in the workplace while strengthening employee rights.

Currently, contracts of employment are typically tailored to employers’ needs and outline the terms of engagement—whether casual, part-time, fixed-term, or permanent. Section 2 of the existing Employment Act defines a contract as an agreement where one party provides labour for wages or benefits under the orders of another. Employers prepare these contracts, but they must comply with prevailing labour laws. Section 37 of the Act specifically states that any contract offering less favourable conditions than the law provides is null and void.

The upcoming Bill introduces more detailed definitions for fixed-term contracts and fixed-term workers, specifying employment for a set period, a specific task, or a particular event. For the first time, these workers are explicitly granted rights comparable to permanent employees, helping create a level playing field.

Section 156 of the Bill outlines that fixed-term employees must not be treated less favourably than permanent staff regarding service qualifications, training opportunities, or chances to secure permanent positions. Exceptions are allowed only for objective reasons, such as seniority, experience, or work performance.

For Botswana entrepreneurs and businesses, these changes signal the need to review employment contracts and HR policies to ensure compliance and fairness. Companies that adapt early will benefit from improved workplace relations, employee satisfaction, and reduced legal risk. By aligning business practices with the new law, employers can maintain competitive operations while fostering an equitable work environment.
